These Terms & Conditions of Sale ("Terms") govern the purchase of products through the website www.anuanuatahiti.com.

By placing an order on our website, you confirm that you have read, understood and accepted these Terms in full. We encourage you to read them carefully before completing your purchase.

2. SCOPE OF APPLICATION

These Terms & Conditions apply to all purchases made by consumers through the ANUANUA online store.

They govern exclusively business-to-consumer (B2C) sales completed via www.anuanuatahiti.com.

They do not apply to:

  • wholesale or professional (B2B) orders;
  • orders placed outside the website, including via email, Instagram, Facebook or any other messaging platform;
  • custom agreements concluded separately with retailers or distributors.

By confirming an order, the customer acknowledges having read and accepted these Terms without reservation.

Customers residing in countries where mandatory consumer protection laws apply continue to benefit from those statutory rights. Nothing in these Terms limits any mandatory legal rights that cannot legally be excluded.

3. PRODUCTS

ANUANUA creates handcrafted jewelry inspired by island life and handmade in Tahiti, French Polynesia.

Each piece is carefully assembled in small batches using selected materials including natural cowries, shell beads, stainless steel, brass components and cotton cords.

Because many materials used are natural, every creation is unique.

As a result, slight variations in:

  • colour;
  • shell shape;
  • texture;
  • size;
  • finish;

may naturally occur from one piece to another.

These differences are an inherent characteristic of handcrafted products and do not constitute manufacturing defects.

Product photographs are intended to faithfully represent each design. However, colours may vary slightly depending on individual screens and the natural characteristics of each piece.

Dimensions provided on product pages are indicative. Small variations may occur due to the handmade nature of the products.

4. PRICES & CURRENCY

Prices can be displayed in different currencies using the currency selector available on the website.

Displayed prices are indicative and based on current exchange rates.

Regardless of the currency displayed, all payments are processed in XPF (French Pacific Franc), the official currency of French Polynesia where ANUANUA operates.

Currency conversion is automatically performed by the customer's bank or payment provider using the applicable exchange rate at the time of payment.

Additional bank charges or foreign transaction fees may apply depending on the customer's financial institution.

All prices displayed on the website are tax exclusive.

ANUANUA operates under the French Polynesian tax exemption regime ("franchise en base") and exports are not subject to VAT.

Shipping costs are calculated separately during checkout according to the selected delivery destination and shipping method.

ANUANUA reserves the right to modify its prices at any time.

The applicable price is the one displayed at the moment the order is confirmed.

5. ORDERS

Orders are subject to product availability.

Although inventory is updated regularly, occasional discrepancies may occur due to simultaneous purchases or inventory adjustments.

If a product becomes unavailable after an order has been placed, ANUANUA will contact the customer as soon as reasonably possible and offer either:

  • a replacement product of equivalent value (subject to the customer's agreement); or
  • a full refund of the unavailable item.


An order becomes legally binding only once payment has been successfully received and accepted.

A confirmation email summarising the order details is automatically sent after validation.

Orders may be cancelled by the customer within the conditions described in these Terms.

Before an order enters the Prepared or Shipped stage, customers may request the cancellation of one or more items.

However, products cannot be exchanged or substituted within an existing order.

If a customer wishes to purchase a different item, the original item must first be cancelled (where possible), and a new order placed separately.

ANUANUA reserves the right to refuse or cancel any order in cases including, but not limited to:

  • suspected fraudulent activity;
  • payment issues;
  • pricing or technical errors;
  • product unavailability.


Pre-orders, when offered, will be clearly identified on the relevant product page together with their estimated production schedule.

6. PAYMENT

Payment in full is required at the time the order is placed.

ANUANUA currently accepts the following payment methods:

  • Credit and debit cards


Payments made by card are securely processed through PayZen by OSB.

Payment information is encrypted and transmitted directly to the payment provider. ANUANUA does not have access to, nor does it store, customers' banking information.

Orders paid by bank transfer will only be processed once the full payment has been received.

Should a payment be declined, cancelled or fail for any reason, the corresponding order will not be processed.

7. SHIPPING & LOCAL PICKUP

Delivery Areas

ANUANUA currently ships to most countries worldwide from Tahiti, French Polynesia.

Available delivery destinations and shipping options are displayed during checkout and may change without prior notice.


Order Preparation

Every ANUANUA piece is carefully handmade and prepared in our Tahiti workshop.

Orders are generally prepared within 2 to 4 business days, excluding weekends and public holidays.

During busy periods such as collection launches, promotional events or holidays, preparation may take up to 6 business days.

Preparation times are estimates only and may occasionally vary.


Shipping Methods

Depending on the destination, ANUANUA may use:

  • Fare Rata (French Polynesian Postal Service);
  • Air Tahiti Freight (French Polynesia only);
  • Any other carrier deemed appropriate for the destination.


Shipping methods available for each destination are displayed during checkout.


FREE STANDARD SHIPPING

ANUANUA offers free standard shipping on orders of XPF 18 000 or more.

For customers browsing the website in another currency, approximate equivalent values may be displayed for convenience only. As all payments are processed in XPF (French Pacific Franc), eligibility for free shipping is determined based on the final order value in XPF.


Delivery Times

Estimated delivery times are provided for guidance only.

Typical delivery times are:

French Polynesia

  • Fare Rata: approximately 3–7 business days
  • Air Tahiti Freight: approximately 24–48 hours



Australia

  • Approximately 7–18 business days.



New Zealand

  • Approximately 7–18 business days.


Europe

  • Approximately 7–21 business days.


United Kingdom

  • Approximately 7–21 business days.


Canada

  • Approximately 7–21 business days.



Delivery times may vary due to customs clearance, weather conditions, transport disruptions or circumstances beyond ANUANUA's control.

ANUANUA cannot guarantee delivery dates and shall not be held liable for delays caused by shipping carriers or customs authorities.


Shipping Costs

Shipping costs are calculated during checkout according to the destination and selected shipping method.

The shipping rates displayed at checkout prevail over any indicative rates published elsewhere on the website.


Local Pickup

Customers located in Tahiti may choose to collect their order directly from the ANUANUA workshop free of charge.

Orders may only be collected after the customer has received the "Ready for Pickup" email.

Orders must be collected within 30 calendar days after the pickup notification has been sent.

If an order is not collected within this period and no prior arrangement has been made, ANUANUA reserves the right to cancel the order and issue a refund, excluding any costs already incurred for personalized products.


Customs Duties & Import Charges

Orders shipped outside French Polynesia may be subject to customs duties, VAT, import taxes or other charges imposed by the destination country.

These charges:

  • are determined by local authorities;
  • are not included in ANUANUA product prices or shipping costs;
  • remain the sole responsibility of the customer.


ANUANUA has no control over these charges and cannot estimate their amount.


Transfer of Risk

Risk of loss or damage passes to the customer upon delivery of the order to the customer or any person designated by the customer to receive it.


Delivery Issues

If a delivery problem occurs, customers are encouraged to contact ANUANUA as soon as possible at:

Depending on the situation, ANUANUA may open an investigation with the carrier.

For parcels marked as delivered but reported as not received, additional documentation (including proof of identity or a sworn statement) may be requested if required by the carrier.

ANUANUA cannot be held responsible for delivery failures resulting from inaccurate or incomplete delivery information provided by the customer.

8. RIGHT OF WITHDRAWAL & RETURNS

Customers benefit from the statutory withdrawal period provided by applicable consumer protection laws.

Unless an exception applies, customers may withdraw from their purchase within 14 calendar days from the date they, or a person designated by them, receive the order.

To exercise this right, customers must notify ANUANUA by email before returning the products.


Return Conditions

Returned products must:

  • be unworn and unused;
  • be returned in their original condition;
  • include all original packaging;
  • show no signs of wear, damage or alteration.


Returns that do not meet these conditions may be refused or subject to a partial refund reflecting any loss in value.


Return Shipping

Return shipping costs remain the responsibility of the customer unless otherwise required by applicable law.

Returned parcels must be shipped using a tracked shipping service.

The customer remains responsible for the returned parcel until it has been received by ANUANUA.

If a returned item arrives damaged due to insufficient packaging during transport, ANUANUA reserves the right to reduce or refuse the refund depending on the condition of the returned product.


Refunds

Once the returned products have been received, inspected and approved, refunds will be processed within 3 business days using the original payment method whenever possible.

Depending on the customer's bank, additional processing times may apply before the refunded amount appears on the customer's account.

Shipping costs are refundable only where required by applicable consumer protection legislation.


Exchanges

ANUANUA does not currently offer product exchanges or store credit.

Customers wishing to purchase a different item are invited to place a new order once the return process has been completed.

9. PERSONALIZED ORDERS

Certain ANUANUA pieces may be customized upon request, including adjustments to colour, size or other design elements, where technically possible.

Customization requests may be submitted:


Whenever applicable, ANUANUA will send the customer a photograph of the finished personalized piece for approval before shipment.

Because personalized products are created specifically for one customer, they cannot be cancelled, returned or refunded once production has begun, except where mandatory consumer protection laws provide otherwise or where a manufacturing defect is confirmed.

10. LEGAL WARRANTY

ANUANUA takes great care in the creation and quality control of every handmade piece.

Customers benefit from the statutory legal guarantees applicable under mandatory consumer protection laws.

If a product presents a manufacturing defect or does not conform to the order placed, customers are invited to contact ANUANUA as soon as reasonably possible by emailing hello@anuanuatahiti.com, together with photographs clearly showing the issue.

Each request is reviewed individually.

Where a defect is confirmed, ANUANUA will determine the most appropriate solution, which may include:

  • repair;
  • replacement;
  • or a full or partial refund, depending on the circumstances.


This warranty does not cover damage resulting from:

  • normal wear and tear;
  • accidental damage;
  • improper use;
  • failure to follow the care recommendations;
  • modifications or repairs carried out by third parties.

11. LIABILITY

ANUANUA is committed to providing products that conform to their description and to exercising reasonable care in the performance of its obligations.

To the fullest extent permitted by applicable law, ANUANUA shall not be held liable for indirect, incidental or consequential damages arising from the purchase or use of its products.

Nothing in these Terms excludes or limits liability where such limitation would be unlawful.

Customers acknowledge that handcrafted jewelry requires appropriate care and maintenance.

The appearance and longevity of each piece depend largely on how it is worn, stored and maintained.

12. CARE RECOMMENDATIONS

To preserve the beauty of your jewelry over time, we recommend:

  • removing your jewelry before swimming, showering or exercising;
  • avoiding prolonged contact with water, perfumes, cosmetics and household chemicals;
  • storing each piece in its protective pouch or another dry, closed container;
  • removing jewelry before sleeping whenever possible.

Natural materials and gold-plated finishes evolve over time depending on how they are worn and cared for.

Following these recommendations will help preserve the appearance and durability of your jewelry.

13. INTELLECTUAL PROPERTY

All content available on the ANUANUA website, including but not limited to:

  • photographs;
  • product descriptions;
  • texts;
  • graphics;
  • logos;
  • illustrations;
  • videos;
  • visual identity;
  • jewelry designs;
  • collection names;
  • product names;
  • original concepts;

is protected by applicable intellectual property laws.

The ANUANUA trademark is a registered trademark.

Any reproduction, imitation, modification, distribution or commercial use, in whole or in part, without prior written authorization from ANUANUA is strictly prohibited.

Sharing ANUANUA content on social media for non-commercial purposes is welcomed, provided proper credit is given.

14. PERSONAL DATA

ANUANUA collects and processes personal information solely for purposes related to:

  • order processing;
  • customer service;
  • delivery;
  • newsletter subscriptions (where applicable);
  • legal and accounting obligations.

Personal data is processed in accordance with applicable data protection laws.

15. GOVERNING LAW & DISPUTE RESOLUTION

These Terms & Conditions are governed by the laws applicable in French Polynesia and, where relevant, by the mandatory provisions of French consumer law.

Before initiating legal proceedings, both parties agree to make every reasonable effort to resolve any dispute amicably.

Nothing in these Terms affects any mandatory rights granted to consumers under applicable law.

Where applicable, consumers residing within the European Union may also access the European Online Dispute Resolution platform or any equivalent dispute resolution mechanism available in their jurisdiction.

16. FORCE MAJEURE

ANUANUA shall not be held liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

These circumstances may include, without limitation:

  • natural disasters;
  • cyclones;
  • floods;
  • fires;
  • pandemics;
  • strikes;
  • transport disruptions;
  • customs delays;
  • supply chain interruptions;
  • governmental measures;
  • or any other event generally recognised as force majeure.


During such events, ANUANUA's obligations shall be suspended for the duration of the event.

17. AMENDMENTS

ANUANUA reserves the right to amend these Terms & Conditions at any time.

Any modifications shall apply only to orders placed after the updated version has been published on the website.

Customers are encouraged to review these Terms before placing each order.
